1. INFORMATION ABOUT TUESDAY EDITIONS

1.1 - The website www.mardi-editions.com (hereinafter the "Website") is managed and operated under the responsibility of:

1.2 - The Website is a platform for the discovery, sale and purchase of women's ready-to-wear clothing and accessories online (hereinafter, the "Service").

1.3 - Any question or complaint relating to the Site, these general terms and conditions of use (hereinafter, the "GTC"), the general terms and conditions of sale (hereinafter, the "GTC"), the privacy charter (hereinafter, the "Charter") and the policy relating to cookies (hereinafter, the "Cookie Policy") may be addressed to Mardi Editions at the address mentioned above or at the following email address: hello@mardi-editions.com.

 

2. ACCEPTANCE

2.1 - Access to the Site is subject to these GTC, the Charter, the Cookie Policy and the applicable laws and regulations. Consequently, access to the Site implies full and unreserved acceptance by the user (hereinafter, "the User") of these GCU, the Charter and the Cookie Policy.

2.2 - These GTC, the GTC, the Cookie Policy and the Charter exclusively govern the relationship between the User and Mardi Editions concerning the use of the Site and the Service. They can be consulted at any time on the Site.

 

3. ACCESSIBILITY AND OPERATION OF THE SITE

3.1 - Mardi Editions will ensure, as far as possible, that the Site is up-to-date and remains accessible to a normal number of Users. However, Mardi Editions does not guarantee that the functions of the Site will be available without interruption or without error, that defects will be corrected immediately or that the server that makes it available is free of viruses or other harmful components.

3.2 - Mardi Editions cannot be held liable for any loss and/or damage of any kind whatsoever resulting from the suspension, interruption, (technical) disruption, slowdown, difficult accessibility and/or cessation of accessibility to all or part of the Site or from viruses or other harmful components on the Site.

3.3 - If the User notices the presence of an error, a virus or other harmful elements on the Site, he/she is invited to communicate this to Mardi Editions at the following address: hello@mardi-editions.com so that the necessary measures can be taken. In any case, Mardi Editions advises the User to install firewalls, anti-virus software and other necessary protection software on his computer in order to prevent possible damage to it.

3.4 - Mardi Editions retains the right to suspend or stop all or part of the Website at any time, without justification and without prior notice.

 

4. USE OF THE SITE

4.1 - The User undertakes to use the Site in accordance with its purpose only, to the exclusion of any other purpose.

4.2 - The User is obliged to ensure that all information he/she communicates is accurate and up-to-date.

4.3 - The User undertakes to use the Site in good faith and to comply with the legislation in force, and in particular to refrain from :

  • Sending to Mardi editions content or communications that are false or misleading (and to update such content, if necessary, to ensure that it does not become false or misleading), obscene, racist or xenophobic, abusive, illegal, deceptive, invasive of another's privacy, offensive, harmful, violent, threatening or harassing, defamatory, infringing of any intellectual property right or any other right, or which encourages or participates in any of the foregoing;
  • Providing email addresses or other content to Mardi Editions without obtaining the prior consent of the persons concerned;
  • Sending content to Mardi editions that violates the rights of a third party or harms them in any way (intellectual property rights, privacy, business secrets etc.);
  • Sending to Mardi editions content that directs to illegal websites or that contains inappropriate content;
  • Use the Site to send spam, unsolicited mail, pyramid schemes or any similar or fraudulent process;
  • Circumventing technical protection devices for documents and multimedia elements;

Any action that may interfere with the proper working of the Site, the Service, including the use of worms, viruses, software bombs or mass mailings;

  • Attempting to breach unauthorised access to any part of the Site or equipment used in the operation of the Site;
  • Use a false name, alias, or impersonate any other person or entity;
  • Use the Site for purposes other than those set out in the GCU.

4.4 - Mardi Editions cannot be held responsible in the event of non-compliance by the User with the GTC, the GTC, the Cookie Policy, the Charter and/or the applicable laws or regulations.
The User guarantees Mardi Editions against any action, claim or complaint from third parties (including public authorities) relating to his use of the Site.

4.5 - The User uses the Site at his own risk. The Site, its components and all the information, software, installations and services related to it are provided as is, according to availability, without any guarantee of any kind (neither express nor implicit) and within the limits of the applicable law.

4.6 - Mardi Editions accepts no responsibility for any loss or damage (direct, indirect, material or immaterial) resulting from the use of the Site and its components, or from the inability to use the Site.

4.7 The User is also required to inform Mardi Editions immediately in writing if he/she becomes aware of any inappropriate behaviour or use in relation to the Site by sending an email to the following address: hello@mardi-editions.com.

 

5. LINKS TO AND ON OTHER SITES
5.1 - Hypertext links to other websites may appear on the Site. In addition, certain websites may include a link to the Site. These third-party sites are not controlled by Mardi Editions, which therefore assumes no responsibility for their operation, content and use. Unless expressly mentioned otherwise by Mardi Editions on the Site, the existence of such links does not imply any approval by Mardi Editions of these third party sites or the use that may be made of them, nor any association or partnership with the operators of these sites.

 

6. INTELLECTUAL PROPERTY RIGHTS

6.1 - The Site and its components (trademarks, logos, graphics, photographs, animations, videos, music, texts, etc.) are the property of Mardi Editions. They are protected by intellectual property rights (in particular copyright, design rights, trademark rights, etc.) and may not be reproduced, used or distributed without the prior written authorisation of Mardi Editions or, where applicable, of the holder of the rights concerned, under penalty of constituting an infringement of copyright and/or design rights and/or trademark rights, punishable by a fine of between three months and three years and a fine of between 100 and 100,000 euros, or one of these penalties only.

6.2 - Mardi Editions hereby grants the User a non-exclusive, non-transferable licence, for an indefinite period and revocable at any time without giving any reason, to access, display and download the content of the Site solely for the purposes of display. The User may also print a copy of the content displayed on the Site for his/her personal needs, provided that he/she does not alter the content of the Site in any way and that he/she retains all mentions of authorship and origin of the Site. Reproduction is therefore only authorised for strictly private purposes within the meaning of Article XI.190 5° of the Economic Law Code.

6.3 - Any use of the Site and its components not covered by this article is strictly prohibited.

 

7. MODIFICATIONS AND LANGUAGE VERSIONS

7.1 - Mardi Editions reserves the right to modify and update, at any time, by notifying the Users through the Site, the present GTC, the GTC, the Charter, and the Cookie Policy, the access to the Site and its content. All of these modifications are binding on Users each time they access the Site.

7.2 - In the event of discrepancies between the language versions of these GTC, the GTC, the Charter or the Cookie Policy, the French language version shall prevail.

 

8. VALIDITY OF CONTRACTUAL CLAUSES

8.1 - Mardi Editions' failure to invoke, at a given time, a provision of these GTC shall not be construed as a waiver of its rights under the same at a later date.

8.2 - The nullity, invalidity or unenforceability of all or part of one of the preceding or following provisions shall not entail the nullity of the whole of these GCU. The provision that is entirely or partially null, void or unenforceable shall be deemed unwritten. Mardi Editions undertakes to replace this provision with another that pursues, as far as possible, the same objective.

 

9. APPLICABLE LAW AND COMPETENT JURISDICTION

9.1 - The validity, interpretation and/or execution of the GCU are subject to Belgian law, to the full extent permitted by the applicable rules of private international law.

9.2 - In the event of a dispute relating to the validity, interpretation or performance of the GTC, the Courts and Tribunals of the judicial district of Brussels shall have exclusive jurisdiction, to the full extent permitted by the applicable rules of private international law.

9.3 - Before taking any steps towards the judicial resolution of a dispute, the Buyer and Mardi Editions undertake to try to resolve it amicably. To this end, they shall first contact each other, before resorting, if necessary, to mediation, arbitration or any other alternative dispute resolution method.
